A: Chapter 11 under the Federal Bankruptcy Code allows companies to continue operating and maintain control of the company while reorganizing its business and arranging a payment plan to its creditors.

Q: Why did Malden Mills Industries, Inc. file for Chapter 11?

A: After a devastating industrial fire on December 11, 1995, Malden Mills, a privately-held company, worked with its lenders and strategic advisors and determined that a Chapter 11 filing was necessary due to a number of factors such as the cost of servicing bank debt, a sluggish retail market, the high costs associated with rebuilding, and the closure of the company’s upholstery division after a significant market share loss as a result of the fire.

Q. Is Malden Mills Industries, Inc. going out of business?

A: Absolutely not. This reorganization will allow Malden Mills to emerge from the challenges they have faced since the fire with a stronger, more highly focused and profitable company.

A: At this time, a Bar Date has not been established.  All potential creditors will receive the Bar Date Notice and instructions after a date has been established.

Q: I am a former employee and have received a proof of claim form.  Why?
